Diagnostic Disclaimer

1. Not a Substitute for Professional Inspection
OmniSpark is a digital diagnostic intelligence tool designed to assist users in narrowing down structural, mechanical, and electrical vehicle issues. However, the information provided by OmniSpark is derived purely from self-reported symptoms and remote data aggregation. OmniSpark's outputs are diagnostic estimations and do not constitute absolute mechanical certainties.You should always have a certified technician perform a physical, hands-on inspection of your vehicle before making large financial decisions or attempting complex repairs.

2. Assumption of Risk (Safety & DIY)
Vehicles are heavy machinery, and working on them poses severe risks of injury or death. If you choose to execute a "DIY" repair based on OmniSpark's part recommendations or troubleshooting steps, you do so entirely at your own risk. OmniSpark, its parent company (Pops Motors LLC), its developers, and affiliates assume zero liability for property damage, vehicular damage, injury, or death sustained while acting upon the information provided by this application. Furthermore, if OmniSpark flags an issue as a "SAFETY" risk, you are urged to cease operating the vehicle immediately. Ignoring this warning transfers all subsequent liability to the operator.

3. Third-Party Parts & eCommerce Fulfillment
OmniSpark may provide dynamic links to aftermarket parts via third-party vendors (e.g., Amazon, eBay). OmniSpark is an independent protocol and is not responsible for the quality, fitment, shipping, or warranty of any parts purchased through external retail links. Purchases made through third-party platforms are governed by the return policies of those respective platforms.

4. OmniSpark Direct Parts Concierge
For parts ordered directly via the "Order through OmniSpark" Concierge service, fulfillment is handled by authorized local distributors (e.g., O'Reilly Auto Parts). OmniSpark acts as the coordinating reseller. While we strive to ensure 100% fitment accuracy based on the vehicle data you provide, any liability for incorrect installation or part-failure rests with the part manufacturer's warranty.

5. Returns & Refunds — OmniSpark Concierge Orders
Parts sourced through the OmniSpark Concierge service are subject to the following return policy:

  • Return Window: Returns are accepted within 30 calendar days from the date the part is made available for customer pickup.
  • Condition Requirement: The part must be unused and uninstalled in its original packaging. Parts that have been installed, modified, or show evidence of use are not eligible for return under any circumstance.
  • Restocking Fee: A 10% restocking fee will be deducted from the refunded amount on all eligible returns. This fee covers coordination, storage, and return logistics to the fulfilling distributor.
  • Refund Method: Approved refunds (less the restocking fee) are processed back to the original payment method within 5–10 business days of the returned part being received and inspected.
  • How to Initiate: To begin a return, contact OmniSpark support at support@omnispark.io with your Purchase Order number and reason for return. Returns initiated without prior authorization will not be accepted.

Terms of Service

1. Acceptance of Terms
Access to the OmniSpark application and web services is governed strictly by these terms. By entering vehicle data, generating diagnostic reports, or soliciting repair quotes, you legally bind yourself to these provisions.

2. Service Modifications and Outages
OmniSpark reserves the right to modify, suspend, or discontinue any facet of the diagnostic engine, AI generation, or geographic provider routing at any time without prior notice. We make no guarantees of uninterrupted service or absolute uptime.

3. Intellectual Property Rights
The underlying logic, node-based decision architecture, user interfaces, branding ("OmniSpark", "Pops Motors LLC"), and proprietary source code are the intellectual property of OmniSpark Systems. You may not scrape, reverse-engineer, mirror, or repackage the application's conversational AI or diagnostic outputs for commercial redistribution.

4. Privacy & Lead Capture Consent
By opting to use the "I Need a Part" or "I Need a Mechanic" request flows, you consent to submitting your contact information (Email, Phone, Name, Location) securely to OmniSpark’s internal ledger. This information is used exclusively to fulfill your specific vehicle requests via SMS or Email follow-up. We do not sell your personal data to mass-marketing lead brokers.

5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMNISPARK SYSTEMS AND POPS MOTORS LLC SHALL NOT BE HELD LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY. THIS INCLUDES LOSS OF DATA, LOSS OF USE, OR DIAGNOSTIC INACCURACIES THAT LEAD TO UNNECESSARY VEHICLE REPAIRS.

6. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. Any dispute arising from these terms will be resolved exclusively in the state or federal courts located within Illinois.

7. Returns, Refunds & Restocking
All returns on parts sourced through the OmniSpark Concierge service are governed by the Return Policy detailed in Section 5 of the Diagnostic Disclaimer above. By submitting an order request through OmniSpark, you acknowledge and agree to the 30-day return window, the unused/uninstalled condition requirement, and the 10% restocking fee. Returns are not guaranteed for parts ordered in error due to inaccurate vehicle information provided by the user.
